Speaking while representing NASA senior counsel and Siaya Senator James Orengo maintained that his team is only out to prevent any mischief likely to be witnessed should the company go ahead to produce the papers.

''We are not in any way interested in having the polls interested.Actually, they must be held on August 8,'' said Orengo.

The application was however opposed by Attorney General Githu Muigai who maintained that should the opposition have its way and the 2.5Billion shilling tender revoked, the nation will be thrown into a constitutional crisis.

He said that there is not enough time to cancel and award a new tender with the election only a month and a few days away and this will force for the postponement of the exercise.

''Should the applicant wish be granted, the nation will be thrown into a historic and unprecedented constitutional crisis,'' said the AG.

The opposition is against the tender saying that it was influenced by the government alleging that the company has links with the President and his allies with the Jubilee side teaming up with the national poll body IEBC to defend the process.
