Former Deputy speaker Farah Maalim risks civil jailing if he fails to pay Sh 6 million as the cost for the petition he filed against the re-election of Garissa Township MP Aden Duale during the August General elections.

 Former Law Society of Kenya Chairman Eric Mutua, argues that politicians who do not honor court verdicts on fines will be subjected to a jail term if they lack assets that can be auctioned.

“We call them the decree-holder, the person who has the award in his favor can instruct an auctioneer to look if you have assets to be attached to recover the cost. If you have no assets, you will be committed to civil jail for non-payment,” Mutua said. 

Maalim had moved to court to challenge the victory of Duale, also National Assembly Majority Leader citing illegalities and irregularities. 

The Wiper candidate said that Duale did not win in a free and fair manner. At one point he accused NASA Leader, whom he did not disclose for frustrating him during the petition to unseat Duale.

"I know of a NASA leader who supported Duale in the last general election. Although his influence in Garissa is limited, democracy guarantees everybody freedom of choice. Some leaders have perfected the art of selling support," his since-deleted tweet read in part.
