The IEBC has admitted that there was tallying error in the Embakasi East Constituency results where Babu Owino was declared the winner.
Through Nicholas Kipkorir Butuk, the Returning Officer of Embakasi-East Constituency, it was revealed there were errors, which casts doubt over Owino’s win during the August 8 General Election.
Butuk was testifying before the court in a petition challenging Owino’s win, which was filed by a Mbugua Mureithi, who came second in the polls.
However, the officer further said the errors were not major, and could not affect the final outcome of the elections.
He further indicated that the error only affected the last four candidates, and it could not have any bearing on a change of the top two candidates.
The returning officer further contradicted himself, saying he was working under duress as Owino demanded the results to be released without further delays.
Mureithi had filed a petition seeking to nullify the win, saying the number of those who voted exceeded the registered voters in the area.
He also claims there were issues with forms 35B, which were not all signed as required.
“The number of the people who voted exceeded the number of registered voters,” he said in his petition.
