Embakasi East MP Babu Owino was on Wednesday re-arrested minutes after being released on a Sh500,000 cash bail.
According to police, Babu's second arrest came because of what police termed as inciting the public into violence through his Facebook page.
Owino reportedly wrote that he will never apologise over the 'mtoto wa mbwa' remarks he recently made.
But Milimani chief magistrate Francis Andayi has said that the reasons against Babu's release are not compelling.
"There is no compelling reason to warrant denial of bail. The right of an accused person to be released on bond is enshrined in the constitution and must be respected," he noted.
