Although NASA won the tallying case against IEBC , with the court maintaining that figures announced at constituency level will be final, it is however not the end of the war for the Opposition.

“The IEBC chairman has no power to unilaterally tally, verify, confirm and declare presidential results or to arbitrarily overturn the decision made by voters,” the court said.

But in a setback for NASA and huge win for Jubilee, the High Court on Friday declined to cancel the controversial Sh2.5 billion ballot-printing tender that was awarded awarded to a Dubai firm.

Instead, the judge instead directed that the file be placed before Chief Justice David Maraga to name a three-judge bench that will hear the case tomorrow Tuesday. 

According to Justice George Odunga, the case raises weighty constitutional issues with the election just 44 days away.
