Lawyer Moseti Moseti says IEBC Chairman Wafula Chebukati should be jailed for alleged contempt of court.
On Tuesday opposition lawyer James Orengo claimed that the commission failed to grant them access to IEBC servers despite the orders by the court.
And in his post analysis, Moseti also says the act should be used in the Supreme Court as crucial evidence when they make a determination over the presidential petition filed by Raila Odinga.
“It was very clear that IEBC acted in bad faith and the court confirmed in its report that both parties were not granted access to the severs.
“This alone is a criminal offence since it is in contempt with a court ruling. Chebukati should be arrested and charged,” adds Moseti.
Earlier, IEBC lawyer Paul Muite contended that the delay was as a result of different time zones between Kenya and Europe where the servers are situated.
His argument was later dismissed by CJ David Maraga who demanded that the IEBC contact servers as a matter of urgency.
