A Jubilee Party allied senator risks being locked out of the senatorial race, after a case he is facing, failed to be concluded.
Uasin Gishu senator Isaac Melly, is accused of spearheading violent protests in 2015, with intentions to oust University of Eldoret (UoE) Vice Chancellor Prof Teresia Akenga.
Nakuru principal Magistrate Joe Omido heard that Melly and Prof Akenga had agreed to settle the matter out of Court, Tuesday.
However the complainant failed to send a representative to confirm the out of court settlement, for the Court to drop the charges against the youthful lawmaker.
Through lawyer Ochang Ajigo, Melly asked the Court to drop the charges against him, but the prosecution opposed, saying Akenga must confirm.
Melly is accused alongside politician Jonathan Bii, and a student, Wesley Kogo.
The case will be heard August 23, 2017 after the general election.
This deals a major blow to Melly who is a strong supporter of Deputy president William Ruto, since he seeks to defend his seat, through a Jubilee party ticket. He is also Ruto's senator, since he hails from the North Rift county.
The law recommends that an aspirant should not have a pending case in court, before being cleared to contest by the Independent Electoral and Boundaries Commission (IEBC).
