[Photo|Courtesy]Supreme Court judge justice Jackton Ojwang has issued a detailed judgement, as to why, he dissented, and ruled in favour of the IEBC and President Uhuru Kenyatta, in the August presidential election petition.According to him, the petitioner, NASA presidential candidate Raila Odinga, failed to prove his case, and that IEBC conducted the election in a credible manner."Mr Odinga's broad claims did not warrant its nullification. The majority decision that quashed President Kenyatta’s election was precarious," he said.Ojwang indicated that Raila's claims hinged on only one pillar of the electoral process, the transmission of results.He said there were procedural errors resulting from human errors, and that such, could not warrant nullification of the election, given that the voters did not have any problem with marking the ballot papers.The judge said: "The election was secure, transparent and accountable. Nasa and Mr Odinga, made broad assertions on alleged wrongdoing on the part of IEBC and often invited the court to ascertain the scope of the mistakes. The case, was not valid and was based on weak grounds."
