Former Law Society of Kenya CEO and High Court Advocate Apollo Mboya has filed a lawsuit aimed at stopping the vetting process of the IEBC nominees.
In the lawsuit filed on Monday, Mboya, who wants the vetting process scheduled for Tuesday temporarily halted, accused the IEBC selection panel of violating the law in the recruitment process.
Mboya argued that the selection process for the IEBC positions for chair and commissioners was characterized by inconsistencies and lack of transparency, a breach of the First Schedule of the 2011 IEBC Act and the 2016 Election Laws (Amended).
“Unless the National Assembly is restrained, the candidates nominated for appointment as chairperson and members of IEBC will be vetted and appointed contrary to the law, it is in the interest of justice that my request is granted,” he argued.
Wafula Chebukati was nominated for the electoral body's chair, alongside nine other commissioners.
