Machakos High Court has dismissed a case filed by former Yatta MP Francis Mwangangi seeking to challenge the election of Charles Kilonzo.  According to the court, the petitioner lacked substantive evidence that could lead to the nullification of the outcome of the August General elections. 

The former lawmaker, who contested on Chama Cha Uzalendo Party ticket, had moved to court seeking for the annulling of the results on the grounds that the exercise was marred by all sorts of illegalities and irregularities. He insisted that the win of the incumbent MP does not reflect the will of the people of Machakos. He is yet to speak on his next move following the ruling.

A witness in a petition challenging the election of Kilonzo had earlier told a Machakos Court that exercise’s results were altered by a returning officer. Samuel Mulei, who acted as a polling agent of Chama Cha Uzalendo party (CCU), had alleged Yatta RO alerted forms 35 A and 35 B. He also said that he had denied the agents a chance to access the polling station.
