Anti-Corruption Magistrate Douglas Ogoti denied the 43 among the PS Lilian Omollo, saying that the crimes committed are serious.

The Magistrate in his ruling said that the prosecution had provided sufficient evidence to deny the suspects bail.

He ruled that while bail is a constitutional right, there are scenarios where it cannot be guaranteed or given.

“Basing on the serious crimes the accused persons are linked to, this court hereby denies them bail or bond and they will remain in custody pending their trial,” he ruled.

Ogoti in his ruling said that trial process will be expedited.

He ordered the prosecution to avail and supply all witness statements and evidence material to the suspects' lawyers by Wednesday.

“This court will ensure a speedy trial to ensure that the rights of the accused persons as much as they have been denied bail or bond are not infringed,” he said.

The court further assured the accused persons affair trail based on the constitution.

The 43 suspects were arrested in relation to the NYS scandal.

The Director of Public Prosecutions Noordin Haji says that the second phase of the investigation into the scandal is ongoing and suspects will be arraigned in court soon.
