Ex – Ombudsman Otiende Amollo says October elections will still be nullified by the Supreme Court should opposition leader Raila Odinga boycott.
With just a month to October 26th repeat poll, IEBC is yet to implement a number of demands by the opposition, a move that has angered opposition leader Raila Odinga.
But in reference to article 138(2), Amollo, who also doubles as Rarieda MP says should the commission fail to carry out elections in all constituencies, the exercise will remain null and void.
“IEBC should know that the law which they violated still remains. They better do various reforms or face a similar fate in court.
“The constitution is very clear that elections have to be held in all constituencies and if we boycott, them elections will stand invalidated,” he said, on Tuesday in a TV interview.
Despite the strict constitutional requirement, Otiende however failed to justify his argument given that in elections, IEBC can have zero returns.
Demonstrations are expected across the country to push for radical surgery in the electoral body on Tuesday following Odinga’s decision to revert to mass action.
