Supreme Court has postponed hearing of a case in which three voters sought for the postponement of Thursday's fresh presidential election.
This is after only Chief Justice David Maraga and justice Isaac Lenaola showed up, a move that saw the court lack quorum to issue a ruling.
Reports indicate Deputy Chief Justice Philemona Mwilu, failed to show up following Tuesday evening's incident where her bodyguard was shot and left seriously wounded by unknown assailants.
It is said the incident left her traumatized.
Maraga said some of the judges were sick while some faced transport challenges.
Activist Harun Ndubi, while addressing the press outside the court, said the move was a blow to the country's Judiciary system and right to democracy.
Senior counsel James Orengo, said the move could have been deliberate by the government, so as to allow the fresh poll, to go as planned, contrary to the Opposition's demands.
The Supreme Court which has seven judges, requires at least four judges, to have a quorum.
