A petitioner has called on a court sitting in Nyamira to nullify Kitutu Masaba constituency polls won by Jubilee Party's Shadrack Mose.

The petitioner, through his lawyer Stephen Ligunya contends that Mose's win lacked credibility, accuracy and verifiability.

In his final submissions on Monday, Justus Omiti held that the polls were marred with massive electoral malpractices and therefore its outcome did not represent the will of the people.

On their part, IEBC defended the elections, insisting that it was conducted in strict adherence to the law and the provisions of the constitution.

Through their lawyer Paul Lilan, the electoral agency called on the court to strike out the petition, observing that the election was a true reflection of the people's will.

He, however, admitted existence of administrative errors in the polls but contended that they were not enough to warrant a nullification of the elections.

"An election cannot be nullified because of minor administrative breaches and irregularities," he said.

Mose beat his closest challenger and ODM National Treasurer Timothy Bosire who was the incumbent.
