[Photo: Nation]The court has refused to order embattled businessman Jimmy Wanjigi and his wife, Irene Nzisa to deposit their passports in court.Also, the court refused to enhance Wanjigi's bail terms as requested by the Director of Public Prosecutions Keriako Tobiko on Thursday, saying it was not convinced there was a need to do so. According to Star newspaper, Tobiko through assistant DPP Victor Mule had argued that the Sh50,000 bail given to Wanjigi on Tuesday was 'inordinately low' compared to the gravity of the offences being investigated. Wanjigi was given the order barring police from arresting him or destroying his property.On Thursday, Mule, in an affidavit, said due to the seriousness of the offence allegedly committed, Wanjigi should be ordered to post substantial securities together with sureties.However, Justice Chacha Mwita declined to issue any orders against the businessman."I see no reason to vary the bail terms since the affidavit has not been responded to, to enable me to make a ruling," he ruled.Mwita instead extended the orders against the police pending hearing on December 8.Police on Tuesday broke into the businessman’s palatial home in Muthaiga and found guns in the ceiling. This followed the discovery of firearms at a property linked to Wanjigi in Malindi a day earlier.
