The case involving President Uhuru Kenyatta and William Ruto at the ICC might not be over yet, after the court assigened three judges on the already withdrawn cases.
The court appointed Judges Robert Fremr, Reine Alapini-Gansou and Kimberly Prost to look into the cases involving President Kenyatta, DP Ruto and former journalist Joshua arap Sang.
The cases against the three had collapsed after key witnesses withdrew and others recanted their evidence, leaving the court with no case to pursue.
The Kenyan government was also accused of failing to fully cooperate with the court, failing to provide the needed evidence and documents of certain individuals’ key to the case.
In 2016, ICC judges dismissed the charges of crimes against humanity against DP Ruto and journalist Sang, arguing that the prosecution had failed to present sufficient evidence to convict the suspects.
In this particular year, ICC Prosecutor Fatou Bensouda failed to provide enough evidence before Judges Chile Eboe-Osuji and Robert Fremr, leading to the dismissal of the case.
It will be another grueling and draining battle if the case is reopened, going by the long period that the case lasted before it was thrown out.
The cases might erode the steps the country has made in uniting Kenyans, who have since moved on from the 2007 events.
Awakening the cases might bring back the animosity between most communities and Kenyans at large.
