The petition filed by activist Njonjo Mue has raised issues with the Independent Electoral and Boundaries Commission [IEBC] which according to him, the Supreme Court will find enough evidence to invalidate Uhuru's victory.

In his supporting affidavit, Njonjo Mue highlighted that IEBC's failure to address a memo written by Chairman Wafula Chebukati to the Chief Executive Officer was a clear indication that the commission was unable to respond to the twelve issues raised.

Activist Mue also points out that the exit of Dr.Roslyen Akombe ahead of the repeat election was a well-painted picture that the commission was unable to meet the basic requirements of credibility and fairness.

''The exit of Rosylen Akombe was occasioned by serious issues she raised that apparently indicated the imminent risk that the scheduled fresh presidential poll would not satisfy the legal and constitutional framework of conducting an election,''affidavit presented reads.

Njonjo Mue went further to highlight that Chairman Wafula Chebukati's confession that to have a credible election was a hard task for him to guarantee and citing division within the commission was a clear indication that election was unconstitutional. 

Justice Maraga on Wednesday instructed all respondents in the case to file their responses by Sunday, November 12 at 5 pm
