[Photo: presstv.com]With less than 10 days left, to October 26 polls, two Kenyans have gone to the Supreme Court seeking to reverse the court's judgment that annulled the August 8 presidential election.The two, Jackson Ndegwa and Edward Kings, have cited a number of reasons as to why they want the September 1 Supreme Court judgement reversed.First, the two argue that the judgement itself was erroneous and should be overturned. They say it was based on wrong documentation and flawed interpretation of the law and, therefore, the findings were also wrong.The duo says overturning the decision will save the country Sh12 billion set aside for the rerun. They also argue that the Supreme Court should be the last court to sustain and enforce procedural technicalities against a party."Our case raises very serious constitutional issues and legal principles. The earlier move by the registrar to reject the case was a violation of the Constitution of Articles 1, 3-1, 10, 22, 35 and 159," Ndegwa said as quoted by the Star.Ndegwa and Kings also argue that the repeat poll is a huge burden to an already battered economy and the Supreme Court should intervene for the sake of the public interest.Finally, the two litigants say the judgment by the highest court was precedent-setting and might influence more election petitions involving senators, governors and members of the National Assembly, who got elected on August 8.The Supreme Court by a majority decision nullified the August 8 presidential election citing 'irregularities and illegalities' in the transmission of results.
