President Uhuru Kenyatta has asked that Thirdway Alliance party leader Ekuru Aukot be barred from participating in the October 17 repeat poll.
Responding to a case filed by Aukot, the president on Friday argued that the repeat election is between the petitioners that challenged the election and the president-elect.
According to Uhuru, Aukot had earlier conceded defeat after the controversial August 8 election and so there was no need for him to go into the race again.
"I am aware that Aukot through a press statement issued on August 10, 2017 conceded defeat of the election. He cannot therefore state that he wants to participate in the election of 17th October, 2017," he said in a statement through his lawyers Ogetto, Otachi and Company.
"In the case, the petitioners were only two; Raila Odinga and Kalonzo Musyoka. In line with the decision of this Court stated at paragraph 6 above, these are the only two persons together with the 3rd Respondent who are eligible to participate in the election to be held on 17th October, 2017," he added.
