President Uhuru Kenyatta through his lawyers have requested the Supreme Court to eliminate five internal memos filed by the two activists Njonjo Mue and Khelef Khalif challenging his win.

Led by lawyer Melissa Ng'ania who made submissions on behalf of the President's legal team, said the memos were unlawfully acquired and they should not be considered  in court records.

Ng'ania on Tuesday said that no request was made to IEBC before accessing to internal documents as required by law.She said the intended use would otherwise jeopardise the case.

''........if we allow these documents gotten unlawfully be part of the hearing,I tell you for fact that they will jeopardise the case...,''he argued.

Fred Ngatia who is also the part of the Kenyatta's legal team took it far by asking  the court to eliminate documents the petitioners filed arguing that they submitted after the stipulated time.

''What the petitioner have submitted was unlawfully acquired and it was submitted after the set deadline.....,''said lawyer Ngatia.

But counsels Julie Soweto and Harun Ndubi,who are representing the ICJs Kenyan chapter Chairman Njonjo Mue, said the documents are in the public domain and therefore they should not be ignored.
