The Senate Public Accounts and Investments Committee has written to the Director of Public Prosecutions (DPP) Keriako Tobiko, recommending for the prosecution of Murang'a governor Mwangi Wa Iria.
If approved, the governor risks a fine not exceeding Sh5 million, or a three years jail term or both, as per the Committee's Act.
The Committee chairman Prof Anyang' Nyong'o said Wa Iria failed to provide the Committee with information on alleged graft, where he is accused of purchasing land using public funds.
He is believed to have purchased a 34 acres piece of land using Sh340 million at Kobil, within the County, an amount that is way above the normal market rates.
According to the Kisumu senator, the Jubilee governor has been engaging in sideshows whenever he appears before the Committee for grilling over graft in his County.
The Committee declared him a hostile witness, for allegedly refusing to provide details of the land saga and instead accused his senator Kembi Gitura of using the Committee to attack him politically.
