Machakos Wiper gubernatorial candidate Wavinya Ndeti now faces a fresh bottleneck in her bid to oust Governor Alfred Mutua.
This is after Wamunyu Ward MCA, Kyalo Kyuli, moved to the Court of Appeal to challenge the High Court ruling that allowed Ndeti to run for governor in the August 8 elections.
Kyuli, a Member of the Machakos County Assembly, argues that Ndeti should not be allowed to contest in the August polls as she is still a member of the Chama Cha Uzalendo (CCU) party.
On Wednesday, Justice George Odunga quashed the decision by Independent Electoral and Boundaries Commission (IEBC) dispute resolution committee to block the politician from contesting.
Justice Odunga ruled Ndeti is an eligible Wiper party candidate, noting that the Political Parties Disputes Tribunal decided she is a bonafide member of the party that is led by the former Vice President and NASA co-principal Kalonzo Musyoka.
The High Court further ruled that the IEBC committee had no power to nullify the tribunal's decision.
An emotional Ndeti celebrated the landmark ruling saying the IEBC should have consulted further before barring her from the race.
“IEBC needs to be fair. If they could have consulted the Registrar of Political Parties, we could not have reached here (in court). Today it has been seen that Kenya is bigger than Wafula Chebukati and IEBC. All this conflict is now in the past and I have forgiven IEBC," Ndeti said.
