The High Court has directed the Independent Electoral and Boundaries Commission (IEBC) to ensure Wiper Party nominee for Machakos governorship Wavinya Ndeti’s name appears on the ballot paper pending appeal.
The court said that there was no legal grounds to bar the aspirant since she was a member of the Wiper party and as such she could contest for any post in the party.
On Thursday, the electoral commission had declared Wavinya’s nomination by the Wiper Party as irregular and stopped her from contesting the Machakos governorship.
IEBC's Dispute Resolution Tribunal had annulled her certificate on grounds that she was similarly a member of Chama Cha Uzalendo (CCU).
"At the time of the nomination of Ndeti, she was a member of both Chama Cha Uzalendo and Wiper party, which is against the law," said the panel.
The ruling came after a successful petition by MCA Peter Kyalo, a Wiper member, who argued that Ndeti should be disqualified.
Ndeti had filed her appeal at High Court challenging the commission's decision on the Machakos governor race.As at the moment, she is still in the race pending the High Court’s final ruling.
