Making the ruling on Tuesday, Kiambu High Court Judge Joel Ngugi ordered for a detailed bail report before making a determination whether Jane Muthoni Mucheru will be admitted to bail pending the hearing of the murder case.

Justice Ngugi said the application will be heard on December 13. Muthoni, who is also a Principal at Ichachiri Girls High School in Gatundu, Kiambu County, is suspected of having a hand in the killing of her husband.

She is accused of committing the crime between November 6 and November 11 and dumping the body at Kiahuria Farm in Witeithie Dam in Juja.

Prosecutor Catherine Mwaniki, while making her submissions, urged the court to deny the accused bail saying “there was a high possibility she could flee or interfere with investigations”.

Her lawyer, Bernard Muriuki, opposed the prosecution’s application to deny her admission to bail, arguing that her rights were being violated.

“The opposition of bond is a violation of her constitutional rights,” said Muriuki.

Muthoni has been in custody for 21 days and has denied charges of killing her husband.

Similarly, the court issued a warrant of arrest for Nelson Njiru Magati, a Principal of a Technical Vocational Institution based in the coast.

The prosecution told the court that Njiru deserted his place of duty upon learning of the arrest of Muthoni, whom he had been in constant communication according to forensic phone data analysis.
