The High Court has suspended the implementation of the 2013 Election Campaign Financing Act, a law that requires political candidates to submit their financial data to the electoral body IEBC.
In her ruling on Thursday, High Court Judge Justice Roselyn Aburili noted that the order will be in operational until January 12 when the case will be heard.
"The case by ODM through its lawyer Anthony Oluoch raises serious constitutional issues which need to be disposed of urgently," she ruled.
In an application filed by Opposition party ODM through their lawyer Anthony Oluoch, the party described the rules as illegal, calling for its expungement.
"Unenforceable and unreasonable given that it only gave political parties a matter of hours to comply with a requirement that came into being in 2013," Oluoch said.
"No authorized persons have been nominated to vie for any elective position and therefore Section 6 of the Act can't be enforced," ODM's Legal Officer Anthony Moturi added.
