The ODM appeals tribunal has ordered the National Elections Board (NEB) to withdraw Homa Bay governor Cyprian Awiti's nomination certificate.
Through a Twitter communique on Saturday, the party said the slot was to remain vacant until the tribunal heard and determined the case.
This comes after protests rocked Homa Bay county last Tuesday after the incumbent Awiti was declared winner in the gubernatorial race.
According to County Returning Officer Erastus Otieno, Awiti garnered 46,346 votes against Kasipul constituency MP Oyugi Magwanga who got 14,661 votes.
Residents were up in arms, shouting that they would support Jubilee Party leader Uhuru Kenyatta in the forthcoming elections if Magwanga was rigged out.
According to Magwanga's agent Lameck Okeyo who disputed the results, the final tally read out was not genuine.
"You cannot call the press at dawn to stage-manage the release of results. We know the winner in governor race," Okeyo said.
