A woman accused of killing her neighbors 3 year old son was released on Thursday. The accused is said to have given the child traditional alcohol laced with menthol thus leading to his death.

Lucy Nduta was released by Justice Jessie Lesiit after the prosecuters failed to prove that she was the one who gave the child “muratina”.

Ndutta was indicted for the murder of Peter Kimani in February 2015.

While evaluating the evidence presented Justice Lesiit explained how Peter had gone out to play with friend and on his arrival at home later that afternoon started complaining of a stomach ache.

He was then taken to a clinic where he was given referral to Kiambu Hospital and died while being being treated.

The mother and grandmother of the child testified in court that Peter mentioned that Nduta was the one who gave him the alcohol.

Nduta claimed she had emptied the drink into a basin right before leaving and on her return found it missing.

Prosecutors tried to persuade the judge to look at the evidence in an effort to convict the accused however Justice Lesiit stated that the prosecutors had failed to prove the accused was guilty beyond any doubt.

"The evidence adduced in court was shaky and cannot lead to the conviction of the accused person.”I will give the accused the benefit of doubt and acquit her," Lesiit said as reported by The Star.
