Marion Akinyi denied the charges before Kisumu Principal Magistrate Thomas Obutu for the offence she allegedly committed on March 25.

According to the prosecution documents seen by this writer, Ms Akinyi sent the abusive text after her estranged husband failed to send her money for the upkeep of their son.

Akinyi and her ex-husband Maurice Mwangale have a one year-old son.

Akinyi however told the court she did not find anything abusive in the messages she sent Mwangale.

"Your honour I did not intended to abuse anybody I was just pressing him hard to send me the money to support our son. To me I did nothing wrong," said Akinyi.

Akinyi told the court to take action against Mwangale for not supporting his own son, however Obutu dismissed the request.

"Currently we are dealing with a different matter of you sending abusive texts. The best thing to do is to file for a law suit in a civil court for the matter of child support," said Obutu.

Obutu further declined to restrain the Akinyi from seeing Mwangale, as it had been requested by the prosecution.

Obutu said it was hard to put a restraining order on the accused as they have son together.

Akinyi was released on a cash bail of Sh5,000 pending the hearing of the case on 26th June 2016.
