A woman from Keratina area of Nakuru on Tuesday moved to court under a certificate of urgency seeking orders to down a transmission mask that sits on her parcel of land.
Hellen Wangari sued Safaricom Limited alongside her former Landlord Geoffry Githura Mutuura at the Nakuru Environment and Land Court suit No. 339/15 saying that the apparatus has continued sitting on the land in an outright trespass without payment of rent and occupation of land profits.
She claims that the telco owes her Sh13.4 million in rent arrears adding that she sent several notices to the company's finance and legal department.
She claims Safaricom has not been paying her rent since 2013 and now wants the court to order the telco to pull down the installation immediately.
Through her lawyer Kamau Muthanwa, she filed the case on November 24, 2015, before Justice Sila Munyao seeking orders to restrain Safaricom by way of injunction from assessing the land and carrying out the activities related to the mast.
In a sworn affidavit, she also urged the court to provide orders to pull down the base station including the installed apparatus until the application is heard by the court.
