A woman and her son have been arraigned in a Mombasa court for stealing the body of her late husband from a mortuary.
The two are accused of defying a court order that barred them from burying the body.Jane Mbula, the deceased’s second wife, was arrested in Makueni County on August 15, 2017 for contravening the court order, the Standard reports.Mbula was charged alongside a mortuary attendant at the Coast General Hospital and her son, John Mutua, for illegally burying the man, who died in December last year.Ruth Munee Kisavi, the deceased’s first wife, had filed a case seeking to bar Mbula from burying her late husband, Kisavi Jackson Kisangai. In her defense, Kisavi said she is entitled to bury the deceased as per the customary laws since she is the first wife.Senior Resident Magistrate Edgar Kagoni had on August 3, 2017 given the second wife permission to proceed with burial arrangements.The Magistrate gave Mbula permission to bury the deceased but allowed the first wife to participate in the sendoff, a decision the first wife did not agree with.Kisavi petitioned the case before Senior Principal Magistrate Francis Kyiambia on August 4, 2017 was given an order to stop the burial.
