A middle-aged man was arraigned in a Nakuru court on Friday, after his expectant wife sued him of assault.
Mercy Makena, a beauty products dealer based in Free-Area estate in Nakuru town told a packed resident magistrate court in Nakuru that her husband, Philip Kagiri had been assaulting her and threatening to kill her ever since she became pregnant.
The complainant told the court that was presided over by Chief Resident Magistrate Patrick Mwaniki that the accused, who lives with another woman failed to provide for her basic needs together with their five year-old son, but assaults her often whenever she demands for assistance.
The prosecution bench told the court that on a particular night of November 14 this year, the accused came home under the influence of alcohol and repeatedly assaulted the complainant and in that event inflicted grievous bodily harm on her, while also subjecting her pregnancy to a miscarriage risk.
The court heard that the complainant was taken to Pine Breeze Hospital by neighbours who had responded to her distress call, and who later advised her to seek legal action by first reporting the matter to Lanet police station.
The court released the accused on a cash bond of Sh80,000 and directed her to keep off the complainant but provide for her basic needs together with their son.
The court further advised the complainant to seek for a legal action from the childrens’ court should the accused fail to comply with the court order.
The case will be heard on December 18.
