A security firm was on Thursday ordered by a High Court in Nakuru to pay its former employee, Alice Okelo Sh1.6 for illegally terminating her employment in February last year.

The complainant’s advocate, Zablon Moseti had earlier told the court in a petition that the accused had illegally, without notice terminated the employment of his client by mere word of mouth, after she had requested in writing to be allowed to proceed on a maternity leave.

The petitioner had argued that the decision was not only illegal, but inhuman given the fact that his client needed his employer’s support financially and morally during her expectancy period.

He had argued that the accused had breached employment and labour laws by first not renewing the complainant’s contract on six consecutive times since employing her two years ago.

The accused, the petitioner had held had also unlawfully failed to employ the complainant on permanent terms as is required by law after lapse of six months and without a renewal of the contract.

According to the contract letter that was filed together with the petition, the accused had failed to pay the complainant her salary dues upon dismissal, and also failed to give a written notice as is required by law, thus denying the complainant her constitutional rights.

The presiding judge, Abigail Mushila granted the petition, observing in her ruling that the accused - Starcode Security, had violated the constitutional rights of the complainant and also failed to adhere to laws that govern employment.
