A Kisumu court has sentenced a 24-year-old woman to 15 years in jail for sleeping with a minor.
On the 9th of this month, Ms. Judith Wandera stunned the court after she admitted to having sex with a minor.
She was today sentenced to serve a jail term of 15 years, after being found guilty of defilement and intentionally performing indecent act on a minor.
The court was told that she performed the act on July 05 last year at the Kicomi area in Kisumu town. Seven witnesses testified against her, while she failed to produce anyone to testify in her favor.
In her defence, Ms Wandera claimed she could not establish that the boy was in standard seven when they engaged in the act.
She told the court how they met at a bar in Kondele and started dating. She said the boy had dread locks and was by then a boda boda operator, making it difficult for her to ascertain his actual age.
Kisumu Principal Magistrate Joan Wambilyanga, however, dismissed her argument, adding that according to the sexual offences act, she should have shown the steps she took to establish the age of the boy.
“There was no evidence the complainant lied about his age and the accused defense was disregarded based on her failure to prove what steps she took to establish whether the boy was underage,” said the magistrate.
Ms Wandera pleaded for forgiveness saying she has a son, a brother and her mother she was taking care of.
“I am the only person taking care of all of them. Please forgive me I will never repeat the offence,” she pleaded.
Her pleas fell on deaf ears, as the magistrate handed her a jail term of 15 years.
