Governors facing graft charges will not be allowed to access their offices as earlier ruled by the Hig Court Judge Mumbi Ngugi.
This is after the Court of Appeal upheld the ruling on Friday.
According to a tweet by the Office of the Directorate of Public Prosecution (ODPP), Justice Jamila Mohammed who read the ruling on behalf of other two judges maintained that governors facing graft charges cannot be allowed to access their offices.
"Court upholds DPP Noordin Haji's application that Governors Lenolkulal & Waititu remain out of office during the trial of their corruption cases. Justice Jamila Mohammed read the judgement on behalf of Judges David Musinga, Steven Gatembu & Agnes Murgor," read ODPP's tweet.
Kiambu Governor Ferdinand Waitiu had filed an appeal against a ruling that barred him from accessing his office following a graft case he is facing.
The court, according to the ODPP, also dismissed Waititu's application to review his bail terms.
The Kiambu county boss had been released on an Sh30 million bond with a surety of similar amount or a cash bail of Sh15 million.
"Court also barred Governor Ferdinard Waititu from accessing office till the trial is concluded. It also dismissed his application to review (Sh30M bond with one surety of similar amount or Sh15M cash bail) terming them "reasonable & not excessive"," noted ODPP in another tweet.
The ruling means Nairobi Governor Mike Sonko, Waititu and Samburu's Moses Kasaine Lenolkulal remain barred from accessing their offices until when their graft cases will be heard and determined.
