Bungomek community in Bungoma county has been imposed a gust after the Court of Appeal legislated that it can't contend to be marginalised. The court keeled over a High Court verdict that bestowed the community the special marginalised status.
In the initial verdict as recounted by the Standard, High Court judges had affirmed that the Bungomek community is marginalised, adding that its components should be factored in the County Government stances.
The judges had explained that the community, which has a population of 3,704 people as per the 2009 government statistics, is a contingent and had lived to be deemed less essential by the Bungoma County Government.
“What is important is the fact that the Bungomek represent the ethnic diversity of Bungoma County," the High Court affirmed in legislation read by Justice Alfred Mabeya.
Adding that the county leadership should have acclimated the community by multiplicity and through nominating its members in county positions.
"The Appeal Court, though, substantiated that despite the Bungomek existing as a contingent, they were not marginalised.
Disgracing the High Court judgement, saying the judges had conducted inconsistently to the Constitution by getting entangled in how the county government enrols its staff.
“The appeal is therefore allowed,” the Appeal Court judges sanctioned.
