A special sitting to discuss the troubled Ferdinand Waititu's impeachment motion will be conducted on Tuesday, January 21, Speaker Ken Lusaka has directed.
This is the contrary of section 33 of County Government's Act which states that impeachment of a governor must be discussed not later than 10 days after an impeachment motion is passed successfully. The gazette notice dated on January 10 doubts the legality of this special sitting.
However, Lusaka confirmed that he had received a letter from Speaker Stephen Ndicho of Kiambu county assembly on December 23, 2019 approving the MCA's decision to impeach Waititu.
"Upon receipt of a letter from the Kiambu County Assembly Speaker Stephen Ndicho dated December 20 and received on December 23, 2019, on the approval of motion for the removal from office of governor by impeachment, the Senate will be hearing the charges against the governor,” stated Lusaka.
The law entails the discussion of governor's impeachment a week after receiving reports from the county government. The Senate then chooses a special committee to discuss the matter tabled.
This special seating was reached after the majority leader in the Senate, Senator Kipchumba Murkomen was backed up by 15 senators after he called for a special sitting in December 2019.
"If a majority of the senators vote to uphold the impeachment charge, the governor ceases to hold office. If the senators vote to reject, the speaker should notify his county assembly counterpart of the verdict,” says the Act.
Among the issues discussed by the Senate will be the extension of the term of the Ad Hoc committee of Managed Equipment Services(MES) to counties.
