Nairobi Governor Mike Sonko's lawyers had moved to High Court seeking anticipatory bail ahead of his arrest.
Sonko's a team of lawyers led by Cecil Miller, George Kethi and Michael Osundwa had under a certificate of urgency gone to the High Court to have their client bailed out.
However, High Court judge John Onyiego turned their request down.
"That pending inter- parties hearing and determination of the application the court be pleased to grant reasonable bail or bond terms to Mike Sonko following his arrest and impending arraignment in court by the State," said Miller in the court papers.
Sonko who was on Friday arrested in Voi on his way to Mombasa after the Director of Public Prosecutions (DPP) Noordin Haji ordered for his immediate arrest over the loss of Sh357m will spend the weekend behind bars.
Confirming the arrest, EACC said Sonko attempted to escape before being arrested.
"EACC Kenya confirms that Nairobi City County Governor Mike Sonko Mbuvi has been arrested while escaping arrest at a road block in Voi and is being transferred to Nairobi to face charges of corruption and economic crime," EACC tweeted.
He was then moved to Nairobi using a police helicopter and later escorted to EACC offices.
Sonko in a press statement, however, said that he was not escaping as sections of the media have reported.
