The Supreme Court is this morning expected to make a ruling on a petition challenging the election of Marakwet East Member of Parliament Bowen Kangogo.
Petitioner, Sammy Kemboi, a voter in the constituency moved to the apex court after the Court of Appeal sitting in Eldoret overturned a High Court decision to quash the election of Kangogo.
Eldoret High Court Judge Kanyi Kimondo had nullified the election of the Jubilee MP late February last year on grounds that the exercise was marred with massive irregularities and illegalities.
A three-judge bench at the Court of Appeal comprising of Justices Erastus Githinji, Hannah Okwengu and Jamila Mohammed, however, reinstated Kangogo on July 12, 2018, forcing the petitioner to challenge the decision at the Supreme Court.
The decision of the highest court in the country will be final.
During the 2017 elections, Kangogo was declared a winner by the Independent Electoral and Boundaries Commission (IEBC) after garnering 14, 812 votes with Linah Jebii Kilimo, an independent candidate getting 13, 845 votes.
The Supreme Court will also be making a ruling on several other election petitions.
