Babu Owino should pray that DJ Evolve who he allegedly shot at B club in Kilimani area, Nairobi makes a full recovery.
Currently, Babu Owino is facing the charges of attempted murder and has been freed on an Sh10 million cash bail.
The charges against the Embakasi Member of Parliament are however subject to change depending on the health condition of DJ Evolve who is currently receiving treatment at Nairobi Hospital.
In the event that the health condition of the victim worsens and he, unfortunately, passes on, the charges against Babu Owino will elevate to first-degree murder.
But for as long as the victim's health condition is stable, the charges against the legislator will remain to be attempted murder.
Babu Owino's lawyer Cliff Ombetta admitted that the charges against his client would depend on the health status of the victim.
Ombetta made the statement before Babu Owino was arraigned and charged.
"At this particular moment, I cannot be able to tell you where the charges that will be preferred are determinable at the moment. Why? Because the victim is still in the hospital. In as much as he has done a lot of recoveries, for the charges to be brought to court one of the things is the condition or the status of the victim. So until that one is also confirmed, then that one we cannot be able to say," Ombetta stated.
Babu Owino is also reported to have been paying for the hospital bill of DJ Evolve soon after he was admitted.
At the time of his arraignment in court, the MP had already paid Sh600,000.
The defence may have realized that it is in its own best interest to take care and facilitate the recovery of the complainant in the case to avoid elevation of charges.
